- Information on Access to Case Files
Pursuant to Section 38(1) of the Administrative Procedure Code, parties to the proceedings and their representatives have the right to access case files. Access by persons other than those mentioned above is governed by Section 38(2) of the Administrative Procedure Code. A request for access to case files must always be submitted in advance. The specific date for accessing the file is set by the authorized person following prior agreement. A written record must be made of each instance of file access. The record shall document the course of the access and other relevant facts.
The NAB applies the following procedural framework when handling complaints related to the activities of higher education institutions. The NAB has the competence to deal with matters concerning compliance with the Higher Education Act, the Government Regulation on standards for accreditation in higher education and other legal regulations in connection with provision of higher education. On the other hand, the NAB is not entitled to intervene in proceedings between higher education institutions and the student or to review the course of studies of individual students. The NAB does not act as an appeals body or a supreme body to higher education institutions.
This document sets forth the procedure applied by NAB regarding complaints submitted by higher education institutions, higher vocational schools, or individuals. The process applies to complaints regarding the conduct of NAB’s accreditation processes or other quality assurance procedures, as well as against individuals involved in these procedures on behalf of NAB. It does not constitute a review or appeal against the outcome of these procedures, typically against administrative decisions of NAB, where the process is bindingly governed by the Administrative Procedure Code. Similarly, this process does not apply to submissions in the form of inquiries, requests for an opinion, or requests for a statement.
